2. Product Pricing
Data, including prices, may be inaccurately displayed on our site due to site code or typing errors. While we make every attempt to avoid such errors, they may occur. We do not honor inaccurate or erroneous prices. If a product is listed at an inaccurate price on the website, we will, at our discretion, contact you to offer alternatives. In some cases, your order may be canceled. We will inform you of such cancellations. Our prices are subject to change without notice. We apologize for any inconvenience that this may cause you. 3. Information on our site
At PopUpDisplay.com, we make every attempt to ensure that our description and product details are complete and accurate. Due to the nature of viewing these large displays online, the true size of an object may be hard to gauge. Age, type, and setting of computer monitor can influence the actual color one views on the screen. Further, gloss and coating on the printing medium can influence the colors of final display. We strongly recommend purchasing a material proof to insure the best possible desired match.
In trying to balance protection of the displays and our commitment to greener packaging, actual shipping weights may vary by 10%. On our site, we provide product measurements based on our manufacturing specifications. Actual measurements may vary slightly, but will be within our manufacturing specifications.
4. Site Content
The site and its content including the PopUpDisplay.com logo, all designs, text, graphics, pictures, 'look and feel', information, and other files are the proprietary property of PopUpDisplay.com or its licensors and are protected by copyright and trademark laws, trade dress and other intellectual property rights.
The user is given general access to the site and is prohibited from using part of the site (like image or description) on a different site. Our full site must be displayed within a frame.
5. Privacy Policy
Our site Privacy Policy can be found at popupdisplay.com/privacy/. This privacy policy discloses the information we collect when you visit our site or interact with our site. Your credit card information is never stored at our site or at our offices. Instead, the information is secured at the SecureNet facility which is fully PCI compliant.
6. Cancellation Policy
Orders of custom or graphic pop up displays, modular displays, and banner stands are non-cancelable. Orders for certain stock items may be canceled; however, a restocking fee may apply. If the custom item has not started production, there will be 20% cancellation fee.
7. Shipping
All orders on PopUpDisplay.com are shipped via our FedEx account. Expedited shipping requires an additional fee. We are unable to ship on third-party accounts.
7a. Limits of Liability
PopUpDisplay.com will replace or repair a damaged display if damage occurs during shipment from our manufacturing facility to the customer via FedEx Ground. We will not be responsible for damage occurring during subsequent shipping.
7b. Return Shipments:
We do not accept unauthorized returns or freight collect. Only defective products may be returned once a return authorization number is issued. Claims for defective parts must be made within 5 days of receiving goods. After 5 days, we are not responsible for missing items from an order.
When warranted items are sent, customer will be responsible for the shipping fee.
8. Disputes:
Buyer agrees to pay PopUpDisplay.com an interest rate amount equal to 1% per month, or the maximum provided by law (whichever is less) for invoice amounts that are past due. In the event that PopUpDisplay.com should commence any legal action(s) or otherwise seek to collect payment from buyer, the buyer agrees to pay reasonable attorney(s) and/or collection agency fees, prior to, and subsequent to judgment entered by a court of law, and other expenses incurred by PopUpDisplay.com, whether or not a suit is filed. Customer expressly waives the right to a jury trial. Venue for all disputes shall be held in the magistrate or circuit court of South Carolina.
9. Limitation of Liability
In no event shall PopUpDisplay.com, its Directors and employees be liable for any direct, indirect or consequential damage associated with handling or assembling these displays, loss of data arising from use of our site.
10. Applicable Law and Venue
These Terms and Conditions and your use of this site will be governed by and construed in accordance with the laws of the State of South Carolina. Buyer agrees that any action at law or in equity arising out of or relating to these Terms and Conditions shall be filed only in the state and federal courts located in Richland County, South Carolina and buyer hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of your use of this site, any purchase from this site, or these Terms and Conditions.
